Welcome to EloGuild. These Terms of Service ("Terms") govern your access to and use of the EloGuild website, applications, APIs, Discord bot integrations, and all related services (collectively, the "Service") operated by EloGuild ("we," "us," or "our"). By creating an account, linking third-party identities, browsing as a guest where permitted, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
You must be at least 13 years of age (or the minimum age required in your jurisdiction to consent to data processing and online services) to use EloGuild. If you are under 18, you represent that you have permission from a parent or legal guardian. You may not use the Service if you have been previously suspended or banned, or if applicable law prohibits you from doing so.
You represent that all registration information you submit is truthful and accurate, and you agree to maintain and promptly update such information to keep it accurate. Impersonation of other persons, organisations, or EloGuild staff is strictly prohibited.
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. EloGuild supports authentication through email and password, Steam OpenID, and Discord OAuth, among other methods we may add or remove over time. Linking external accounts is optional unless required for specific features (such as referral verification or contest eligibility).
You may not create multiple accounts to evade enforcement, manipulate leaderboards, abuse referral or points systems, or circumvent blocks. We reserve the right to merge, restrict, or terminate duplicate or fraudulent accounts at our sole discretion.
You must notify us promptly at security@eloguild.com if you suspect unauthorised access to your account.
You agree to use the Service only for lawful purposes and in accordance with these Terms. Without limiting the foregoing, you agree not to:
We may investigate violations and cooperate with law enforcement where required. Enforcement actions include warnings, content removal, feature restrictions, temporary suspension, and permanent termination.
You retain ownership of content you submit to EloGuild, including profile information, posts, comments, messages, clan descriptions, and media links ("User Content"). By submitting User Content, you grant EloGuild a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, distribute, and adapt such content solely as necessary to operate, promote, and improve the Service.
You represent that you have all rights necessary to submit User Content and that it does not infringe third-party intellectual property, privacy, or publicity rights. We are not obligated to monitor User Content but may remove or restrict content that violates these Terms or applicable law.
Other users may view and interact with content you make public according to platform settings. Direct messages and clan applications may be visible to intended recipients and authorised moderators.
Clan owners and officers are responsible for recruitment practices, roster decisions, and conduct within their organisations on EloGuild. We do not guarantee the quality, behaviour, or longevity of any team, player, or match made through Find Your Mate, LFG/LFM posts, or application workflows.
Disputes between users regarding in-game behaviour, voice comms, or offline arrangements are primarily between those users. We may assist with platform-related abuse reports but are not a party to private agreements between players.
From time to time, EloGuild may offer promotional contests, referral programmes, point-based rewards, leaderboards, and prizes as described on the Earn page or in separate official announcements ("Promotions"). Each Promotion may have additional rules regarding eligibility, verification requirements (such as linked Steam or Discord accounts), geographic restrictions, prize delivery, and tax obligations.
Points have no cash value outside active Promotions unless explicitly stated. We may adjust, claw back, or zero balances obtained through error, fraud, or violation of Promotion rules. We reserve the right to modify, suspend, or terminate any Promotion at any time, with or without notice, subject to applicable law.
Employees of EloGuild, immediate family members, and individuals involved in administering a Promotion may be ineligible unless otherwise disclosed. Decisions of EloGuild regarding Promotion disputes are final unless required otherwise by law.
The Service integrates with or links to third-party platforms including Steam, Discord, Medal.tv, and advertising partners. Your use of those services is governed by their respective terms and policies. We are not responsible for outages, policy changes, or data practices of third parties.
Game names, logos, and trademarks are property of their respective owners. EloGuild is not endorsed by or affiliated with game publishers unless explicitly stated.
The Service, including its design, code, branding, logos, and documentation (excluding User Content), is owned by EloGuild or its licensors and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent, except as permitted by law.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
We do not guarantee match quality, recruitment outcomes, contest results, or compatibility between users. You use the Service at your own risk.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELOGUILD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
You agree to indemnify, defend, and hold harmless EloGuild and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.
You may stop using the Service at any time. We may suspend or terminate your access, with or without notice, for conduct that we believe violates these Terms, poses risk to the community, or is otherwise harmful to the Service. Upon termination, provisions that by their nature should survive will survive, including intellectual property, disclaimers, limitation of liability, and indemnification.
We may revise these Terms from time to time. Material changes will be indicated by updating the "Last updated" date below and, where appropriate, through in-platform notice. Continued use after changes become effective constitutes acceptance of the revised Terms. If you do not agree, you must discontinue use of the Service.
These Terms are governed by the laws applicable in our principal place of business, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction as required by applicable law, except where prohibited.
